These are allegations in charging papers, not findings. Law&Crime reports court records list six preliminary felony counts, including shooting a firearm into an inhabited building, intimidation with a deadly weapon and unlawful carrying of a handgun, plus two misdemeanors. The New York Post reports the first three are Level 5 felonies, each carrying up to six years. Wable's initial hearing is set for Oct. 19, Law&Crime reports.
Austen Geoffery Leigh Wable, 28, is charged after police say he fired a gun inside an IHOP in Muncie, Ind., on Thursday, Oct. 8, 2026, Law&Crime and the New York Post report, citing court documents first described by Indianapolis station WXIN. Law&Crime reports court records list six preliminary felony charges: shooting a firearm into an inhabited building, intimidation with a deadly weapon, unlawful carrying of a handgun, pointing a firearm, resisting law enforcement with a vehicle, and operating a vehicle while intoxicated. It reports two misdemeanors as well, for resisting police and driving with a suspended license. The New York Post reports the first three counts are Level 5 felonies, and that a single Level 5 felony carries a maximum of six years in prison.
According to the documents as reported, Muncie police were called to the IHOP in the 3300 block of North Chadam Lane after a report that a man had entered with a gun and opened fire. An employee who tried to calm the situation described Wable as "extremely drunk" and told investigators Wable pushed a cook while accusing him of having sex with his wife, then pointed a handgun at him, Law&Crime reports. The employee said he tried to take the gun and it went off during the struggle. He told investigators he saw a hole in the back of Wable's pants and heard Wable say, "I'm leaking." WTHR reported officers found a firearm and a single shell casing inside, according to Law&Crime.
The New York Post reports Wable then chased the cook in the parking lot with a knife, and that it is unclear whether he brought the blade into the restaurant. He left in his wife's Buick Enclave, the Post reports. Police say he sped off when officers tried to stop the SUV, reaching more than 110 mph, weaving through traffic and driving on the wrong side of the road, and that the vehicle nearly went airborne. The pursuit ended when the SUV crashed into a two-story brick house. Police wrote that Wable got out "stumbling" and "disoriented," Law&Crime reports, and WXIN reported officers used a Taser after he refused commands. He was taken to a hospital for a gunshot wound.
Court documents show Wable was convicted in 2021 of carrying a handgun without a license, a conviction that barred him from carrying a firearm, the outlets report. Law&Crime reports he is held at the Delaware County Jail without bond, with an initial hearing scheduled for Oct. 19. The counts listed are accusations, not convictions, and no plea has been reported. All defendants are presumed innocent until proven guilty in a court of law.

Don Wells, the father of missing Tennessee girl Summer Wells, was charged with domestic assault.
This is an accusation in an affidavit, not a finding, and it has no reported link to Summer's disappearance. What it does is put the family back in the headlines more than five years after a 5-year-old vanished from her own yard. Summer is still missing.
