A Cuyahoga County grand jury indicted Dae'juan Moton on two murder counts in the shooting of Al Rice.
The Cuyahoga County Prosecutor's Office said a grand jury on Oct. 20, 2026, indicted Dae'juan Moton, 24, on two counts of murder and four counts of felonious assault in the Oct. 2 shooting of Al Rice, 45, outside a Piada restaurant in Mayfield Heights. Cleveland 19 reported an arraignment on Oct. 23. The prosecutor's office said the arraignment would be set later, and WKYC reported no date had been announced.

The indictment is the grand jury's charging document, returned Oct. 20. It is two murder counts and four felonious-assault counts. That is a different list from the aggravated-murder count and two attempted-murder counts Mayfield Heights police announced on Oct. 5, which is what WKYC reported was filed in municipal court. Cleveland 19 has him in Common Pleas Court on Oct. 23. The prosecutor's release and WKYC do not.
The Cuyahoga County Prosecutor's Office said a grand jury on Oct. 20, 2026, indicted Dae'juan Moton, 24, on two counts of murder and four counts of felonious assault, accusing him of shooting and killing Al Rice, 45, outside Piada Italian Street Food in Mayfield Heights. The office's headline spells his first name Dae'juan. The same release spells it Dae-juan in the body. Cleveland 19 used both spellings in its Oct. 21 account and reported the same two murder counts and the same four felonious-assault counts. WKYC spelled it Dae'juan, reported he is 24 and from Euclid, and reported Rice was 45 and from Cleveland. The prosecutor's office said he will be arraigned at the Cuyahoga County Justice Center at a later date. WKYC reported an arraignment date had not been announced. Cleveland 19 reported he will be arraigned in Cuyahoga County Court of Common Pleas on Oct. 23. Those are three accounts of the calendar. An indictment is the charging paper. It is not a conviction.
The prosecutor's office gave this account of Oct. 2. At about 4 p.m., Rice went into Piada Italian Street Food near Mayfield Road and Washington Boulevard, met two friends, and Moton came in shortly after. After a brief verbal exchange, Rice and Moton left and walked to their vehicles. Rice then walked to Moton's vehicle, and Moton shot him multiple times. The office said Moton then fired toward the two friends, and that one of the friends fired at Moton and missed. Cleveland 19, citing Prosecutor Michael C. O'Malley, reported the same sequence and reported the restaurant is in the 6000 block of Mayfield Road. O'Malley said, "This is exactly the kind of senseless gun violence that continues to damage our communities. A man lost his life over a brief verbal exchange, and innocent bystanders were put in danger by stray bullets. Thankfully, no one else was hit." The prosecutor's office said Mayfield Heights police and firefighters responded, Moton was arrested at the scene, and Rice was taken to a hospital, where he was pronounced dead. Cleveland 19 and WKYC reported that hospital was Cleveland Clinic Hillcrest Hospital.
WKYC reported what the case looked like before the indictment. The station said that on Oct. 5, Mayfield Heights police announced Moton had been charged with one count of aggravated murder and two counts of attempted murder, and that the other two men who had been detained were released. WKYC reported Lyndhurst Municipal Court Judge Dominic Coletta set bond at $1 million, and that the Ohio Bureau of Criminal Investigation was called in to assist. The Oct. 5 counts are what police announced in municipal court. The Oct. 20 counts are what the grand jury returned. The friends are not named in the prosecutor's release, in Cleveland 19, or in WKYC. All defendants are presumed innocent until proven guilty in a court of law.

Sheriff's officials named Edward Villa as the suspect after Katie Kinder, her son and her mother were found shot to death in Happy Valley.
Thursday's briefing names the three people and names Villa as the only suspect. The warrant was three counts of first-degree murder. He was found dead before an arrest. KPTV, citing Warrenton police, called it an apparent self-inflicted gunshot. KGW reported Detective Matt Lysaght would not go past a gunshot deputies heard, a firearm in the room, and the fact that no officer fired. KPTV and OPB call the motel the South Jetty Inn. An Oahu grand jury indicted Orion Satori on a second-degree murder charge in the Young Street stabbing of Kiril Stoimenov.
An indictment means a grand jury found enough to send the case forward. It is not a finding of guilt. Police have said Satori did the stabbing, according to Hawaii News Now. The next step is arraignment, where he will be asked to enter a plea. Second-degree murder in Hawaii carries a maximum of life with the possibility of parole, the station reported.
