In Texas, killing more than one person during the same criminal transaction is one of the theories that can be filed as capital murder. That is the charge FOX 26 Houston and KPRC reported. A no-bond order at a first appearance is a custody decision. It sets where Herrera waits. It does not decide who fired, or why. The next date is Nov. 5. The case has not been tried.

FOX 26 Houston and KPRC reported Tuesday, Oct. 6, 2026, that David Elijah Herrera, 31, is charged with capital murder in a double shooting on Lindale Street in north Houston, just north of Interstate 610. KPRC identified the people killed as Dariela Cardona, 29, and Erick Gerbitz. ABC13, reporting earlier, identified the man killed with Cardona as Erick Von Gerbitz and said he was the father of her younger son. FOX 26 Houston said the charge rests on the Houston Police Department and Harris County court records. A capital-murder charge is the accusation. It is not a verdict.

KPRC reported the shooting was called in around 8:20 a.m. Monday at a home in the 900 block of Lindale Street. Neighbors told police they heard gunshots, and Cardona and Gerbitz were found dead in front of the home. ABC13 reported the shooting was in the driveway, shortly after the couple had dropped a child at a nearby school, and that Cardona grew up in the neighborhood, was raising two sons, and worked as a hairstylist at the Hive Salon. ABC13 quoted Houston police Detective Mark Holbrook saying someone had been detained and there was no further threat to the public. Those are Monday's police and witness accounts. A jury has not heard them.

KPRC reported investigators believe the shooting may have grown out of a domestic incident involving Cardona and Herrera, possibly her ex-boyfriend, and that he drove past the home, fired multiple shots, and fled. ABC13 reported police described the suspect as Cardona's ex-boyfriend and said he left in a red car. FOX 26 Houston reported Liberty County deputies stopped a red Ford Fusion after a Flock license-plate camera picked the car up, and that Herrera stepped out with his hands up. KPRC placed the arrest near Dayton. ABC13 quoted Holbrook saying a neighbor's video produced a partial plate and that the car was found near Cleveland. Both towns are in Liberty County. The outlets are describing the same stop. They are not a finding that Herrera was the shooter.

FOX 26 Houston reported Wednesday, Oct. 7, 2026, that Herrera made a first appearance that morning and that a judge denied bond after probable cause was read in court. The station identified the people killed as Dariela Elizabeth Cardona, 29, and Erick Von Gerbitz, 41. It said Herrera's next date is Nov. 5 at the Harris County Criminal Courthouse. A no-bond order is a custody decision. It is not a finding that he fired the shots. All defendants are presumed innocent until proven guilty in a court of law.

Tuscaloosa police charged Daronte Collins with felony murder after a Saturday apartment-complex shooting.

WBRC's jail photo is captioned Daronte Collins and puts both men at 22. The Tuscaloosa Thread, citing Violent Crimes Unit Lt. Michael Hall, spells the charged man Deronte and puts both at 20. Patch and the Calhoun Journal also use Daronte and 20. A felony-murder count, which the Thread and the Journal describe as Alabama's rule when someone dies during a robbery, is not a finding that Collins fired the shot that killed Tyson. The Thread says the 25-year-old has not been charged.

High Point police charged Kymberli Bowden with first-degree murder in her 13-year-old daughter's death.

The Oct. 8 release is a new murder count on a case the department charged in 2025 as felony child abuse and concealment of death. It is not a trial. The murder-charge release says she remains in jail with no bond. WXII reported a violent-offense hold and a $1 million bond on the older counts. The 2025 release listed her age as 44. The murder-charge release, WXII, and FOX 35 Orlando list 45.

Chicago police charged Chevazz Campbell in the stabbing death of CTA janitor Julian Mobley.

A detention hearing is the first court date. It is not a finding that Campbell stabbed anyone. The department's Sunday release says he robbed and fatally stabbed a 41-year-old man in the 2000 block of West Lake Street. ABC7 and CBS Chicago name that man as Julian Mobley and describe a fare dispute that turned into a stabbing. The department's charge list and CBS Chicago's shorter summary do not match count for count.
