WNYT reported that Albany County District Attorney Lee C. Thursday's arraignment is the first court appearance on the indictment that names both men. It is not a conviction. Ibrahim and Rampersad each pleaded not guilty. The allegation that they acted together, and that Ibrahim fired the shot inside Rampersad's apartment, is the prosecution's account of the indictment. CBS6's Oct. 5 story charged Ibrahim only.
WNYT reported that Albany County District Attorney Lee C. Kindlon announced Thursday, Oct. 15, 2026, that Khaliq Ibrahim, 23, and Jonathan Rampersad, 24, were arraigned before Judge William Little. Ibrahim is charged with second-degree murder and second-degree criminal possession of a weapon. Rampersad is charged with second-degree murder, two counts of second-degree criminal possession of a weapon, two counts of third-degree criminal possession of a weapon, and tampering with physical evidence. Both pleaded not guilty and were remanded to the Albany County Correctional Facility. An indictment and a not-guilty plea are the start of the case. They are not a finding that either man killed Arell Agapito.
The indictment alleges the two men acted together on Sept. 26 at about 9 p.m., WNYT reported. Prosecutors say Ibrahim shot and killed Agapito, 26, inside Rampersad's apartment at 45 Elberon Place. Prosecutors also allege Rampersad possessed a large-capacity ammunition feeding device and tampered with evidence at the scene. Those are the allegations WNYT attributed to the prosecution. They have not been tried.
CBS6 reported on Oct. 5 that Albany police had arrested Ibrahim that morning in the area of South Allen Street and Cliff Street and charged him with second-degree murder and second-degree criminal possession of a weapon in the Sept. 26 homicide of Agapito on Elberon Place. CBS6 reported that police said Ibrahim shot and killed Agapito. That was the police account of Ibrahim alone. Thursday's announcement, as WNYT reported it, is the indictment that adds Rampersad and places the shooting inside Rampersad's apartment.
The second-degree murder counts, the weapon counts, and the tampering count are accusations. Both men have pleaded not guilty and are being held at the Albany County Correctional Facility. All defendants are presumed innocent until proven guilty in a court of law.

Federal prosecutors charged Rajahshuweh Rhodes, called "Skii Dot," in the 2021 Lower East Side killing of 16-year-old Isaiah Levine.
Five years after a 16-year-old was shot on a Lower East Side corner, the case is now federal, and that changes the stakes. Prosecutors charged Rhodes under racketeering law, alleging the shooting was gang business for the New York Blood Brim Army. Murder in aid of racketeering carries mandatory life or death. These are accusations in an indictment. Rhodes has not been tried, and he has not entered a plea that we could confirm.

A Franklin County grand jury indicted Jacob Iams on murder counts in the stabbing death of Brandon Parsons.
The Wednesday indictment is the common pleas charging paper. It is not a conviction. 10TV's account of a witness, identified in municipal court records as Iams' girlfriend, is the account in those records. A witness statement and a $2 million bond do not decide the murder counts. The next date on the calendar is Oct. 16.
